The Bill (Reg. No.1445) introduced by The President of Ukraine, envisages defining a legal status of State property, to ensure fulfilment of  Authorities by The President of Ukraine, as laid down in The Constitution of Ukraine, and the procedures for managing this property.

 

Attributed to such property are State-owned facilities, required for logistic, social and other provision of the fulfilment of Authorities by The President of Ukraine. Also included in this property is that providing for the operation of Ukraine's Social Security and Defence Council, Representation of The President of Ukraine in the Autonomous Republic of Crimea, and Consultative, Advisory and other Support bodies and Services set up by The President of Ukraine towards fulfilment of his Authorities.

 

The Property providing for the operation of the President of Ukraine, is not subject to alienation from State ownership. No agreements can be concluded with regard to this Property which may lead to alienation of the property from State ownership.

 

Where so required by Laws and Acts of The President of Ukraine, the managing body and companies and organisations  within its governance may be involved in the logistic, social, transport and other provision of The Verkhovna Rada of Ukraine, Cabinet of Ministers of Ukraine and other State bodies, within the limits of Budget appropriations for these purposes or on a contractual basis.

 

The Management of property providing for the operation of The President of Ukraine shall be effected by an Auxiliary body authorised by The President. According to the Bill, the Managing Body is has the right to decide upon creations, reorganisation, and liquidation of companies based in the State-owned property, within the scope of its management; adopt Charters of companies and supervise adherence thereof; conclude and terminate contracts with Company Managers and monitor their execution; approve annual financial and investment plans, and medium-term (3-5years) investment plans, and supervise their execution using the appropriate procedure; issue documents for land titles of land parcels (where the relevant documents are absent); and define the limits of land parcels transferred under a laid down procedure to the Management Body and companies, etc.

 

The Bill envisages that no bankruptcy claims can be instituted with regard to property provided for the operation of The President of Ukraine, nor can this property be forcibly sold.
